A Rockland couple wants a refund because their Maltese puppy peed in the house. The couple says the store sold them the dog with promises that it was “litter box
trained.” The couple says that history proved otherwise.
Mark and Meryl Abrahams say they paid a $300 deposit to Jane Witthohn dba Love on a Leash dba Kuddle Bug Puppy for Maya, a supposedly “litter box trained” Maltese puppy.
Within 24 hours, Maya demonstrated that that was not the case, but the pet store assured the Abrahams that given time, “the dog would be ‘accustomed’ and ‘acclimated’ to the plaintiffs’ home,” according to the complaint.
The Abrahams say they returned Maya 4 days after taking her home, but the defendants refused to give them a refund.
They say that Witthohn banks on customers’ affection for puppies “to perpetrate a scheme to defraud.”
“The defendant intentionally delivered the puppy to the plaintiffs despite the puppy not being as represented, knowing that the plaintiffs would develop a bond and affection for the animal and would therefore be reluctant to reject the same after the puppy had been in the plaintiffs’ home,” according to the complaint.
The Abrahams demand $2,200: the $1,500 purchase price and the cost of a veterinary examination, dog food and a litter box.

This is why NYPD refused to issue press credentials to bloggers. When responsible journalists do a story, they check the facts prior to relating it. While I understand the truth doesn’t always interest people as much as a daytime drama, it does tend to tone down the Jerry Springer mentality of most blog readers and posters.
The dog was not purchased from a pet store, it was purchased from a breeder whose website and personal statements promise that “all of their dogs are fully litterbox trained”. One of the plaintiffs has considerable physical maladies that would make it extremely stressful to have to fully housebreak a puppy, thus making a fully litterbox trained puppy extremely appealing. When the puppy continuously soiled her two beds, the floor, and everything but her litterbox, in an extremely confined area, I believe it demonstrates lack of “truth in advertising”. Then, what do I know. I’ve only been a New York Journalist for 36 years.

I purchased a puppy from Jane a couple of years age and she WAS FULLY litter box trained and continues to be. I am totally delighted with this Maltese and would buy another puppy from Jane before I would buy from anyone else. Perhaps there was something else going on in the household that upset the puppy. Stress can do it as well as a new environment. In any case, it’s too bad the people seemed to have a problem but, as I said before, my Maltese WAS litter box trained and I am TOTALLY HAPPY with this dog purchased from Jane Witthohn. I have had nothing but happiness from my baby and could not ask for a better dog. She is sweet, loving and litter box trained.
